Criminal law in India means offenses against the state, it includes felonies and misdemeanours. The standard of proof for crimes is beyond a reasonable doubt. Criminal law is governed by 3 main Legal Acts- Indian penal Code, CRPC, Evidence Act etc. Besides these major acts, special Criminal Laws are also passed by the Indian Parliament i.e. NDPS, Prevention of Corruption Act, Food Adulteration Act, Dowry Prevention Act,the Defence of India Act,etc. thousands of minor laws are made in India.

Most crimes have necessary components that must be proved in order for an accused to be jailed. For example, in order to convict someone of sedition, it must be proved that there was a call to violence against the government: mere criticisms, no matter how harsh or vulgar, is not enough.
Initially the criminal law preserves the public order and morality. The jurisprudence today knows that no crime can be committed unless there is a mens rea and actusreus. Almost all the crime requires proof of a mental element of some sort.
Due to the technical development, human activities are subjected to statutory liability whenever any person performs an act though he is not having any special state of mind, as require in initial period, then also still he is criminally liable. This is called strict liability; a statute imposes such a liability. Thus, criminal law has evolved from the times immemorial to cyber age and is being developing constantly. Therefore, the first schedule to the Information Technology Act of 2000 has amended certain provisions of the Indian Penal Code 1860. The amended provisions have been widened to include offences involving electronic records. Sec 192 of the Indian Penal Code has amended the meaning of fabricating false evidence to include any false entry in any book or record, or electronic record or making any document or electronic record containing a false statement. These amendments show that the notion of crime is not new but the way of committing the same crime is change.
